12.30 - 2 pm Monday 14 September 1998 ABORIGINAL GEONOCIDE CASE. Aboriginal prosecutors against Genocide - Wadjularbinna Nulyarimma (Gungalidda), Kevin Buzzacott (Arabunna), Isobell Coe (Wiradjuri) and Robbie Thorpe (Booran) - have begun a court action against Howard, Fischer, Harradine and Hanson and all Federal parliamentarians for complicity in the continuing genocide of Aboriginal Nations and Peoples. For nearly fifty years Australia has failed to keep international treaty obligations regarding 1949 Genocide Convention. Australia has failed to enact domestic law to prevent and punish genocide. Genocide is defined as:
This action against further acts of genocide has its foundation in the need for Aboriginal Nations and Peoples to protect themselves and future generations. The concern is that genocide will continue unless restrained by law. There is an unwritten common law right to be protected from genocide. "Genocide has taken on many forms. The land has never been empty. Never been without a system of law. We have our own title to land. We have the law, religion and culture for this land. This is our Sovereignty. We have to be able to control our own lives and live on our own lands again to give our children a brighter future and the quality of life they deserve." - Wadjularbinna Nulyarimma, Gungalidda "The Inquiry (Bringing Them Home) recommended that the Commonwealth legislate to implement the Genocide Convention with full domestic effect. If the Convention had been enacted in the 1950's, most of the harrowing events which were described in evidence to the Inquiry would not have occurred." - Gough Whitlam, Dragging the Chains, 29/8/97
